Locum Notes is provided by Jonathan Wills, a sole trader established in the United Kingdom, trading as Locum Notes (“we”, “us”, “our”). By creating an account or continuing to use the service you agree to these terms, and your contract for use of the service is with us.

1. The service

Locum Notes is a private record-keeping and organising tool for locum and sessional doctors. It lets you record work sessions and earnings, manage practices, create and issue invoices, record expenses and mileage, keep NHS pension record-keeping estimates, store professional documents, and save webpages and reflections as CPD evidence.

Locum Notes is a record-keeping aid only. It does not provide medical, financial, accounting, tax, pension or legal advice, and it does not submit anything to PCSE, HMRC, NHS England or any other body on your behalf. Pension and tax figures are estimates generated from the information you enter and the rates recorded in the app. You remain responsible for checking figures against current official guidance and for your own submissions and returns.

2. Your account

You must be at least 18 years old to use Locum Notes. If you use it on behalf of a business or practice, you confirm you have authority to agree to these terms on its behalf. You must give accurate account details and keep them up to date, keep your login credentials confidential, and you are responsible for activity carried out under your account.

3. Acceptable use

You must not misuse the service. In particular, you must not:

  • use it for any unlawful, fraudulent or deceptive purpose, or to send spam;
  • infringe anyone's intellectual property or other rights;
  • upload malware, probe or test the security of the service, attempt unauthorised access, or scrape or bulk-extract data from it;
  • reverse engineer, decompile, resell, sublicense or redistribute the service, or circumvent any technical or plan limits;
  • store patient-identifiable information or confidential clinical records that you are not entitled to hold outside your clinical systems.

4. Your content

You keep ownership of the records, documents and text you put into Locum Notes. You grant us a limited licence to host, store and process that content solely so we can provide the service to you — for example, generating summaries, calculating figures and producing the exports you request.

5. Our intellectual property

We own the Locum Notes service, its software, design, documentation and branding, and all related intellectual property. You are granted a limited, non-exclusive, non-transferable right to use the service in line with these terms and the plan you have selected. No other rights are granted.

6. Availability

We work to keep Locum Notes available and accurate, but we do not guarantee that it will be uninterrupted, timely, secure or error-free, or that any particular result or figure will be free of mistakes. The service may be unavailable during maintenance or because of events outside our reasonable control.

7. Subscriptions and payment

Locum Notes is offered with a free trial period, after which a paid subscription is required to continue adding new records. Subscriptions renew automatically each billing period until cancelled, and you can cancel at any time; access continues until the end of the period you have paid for.

Payment, billing, currency, taxes, renewals, cancellations and refunds are handled by our reseller. Full details of those mechanics are set out in Paddle's Buyer Terms and in our Refund Policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

8. Suspension and termination

We may suspend or terminate your access if you materially breach these terms, fail to pay for your subscription, create a security or fraud risk, or repeatedly or seriously break our acceptable use rules. Where it is reasonable to do so, we will contact you first and give you a chance to put things right.

You may stop using the service and close your account at any time. If your account ends, you will have a reasonable opportunity to export your records before they are deleted; you can also contact us to request deletion sooner.

9. Warranties and liability

To the fullest extent permitted by law, we exclude all implied warranties, including those of merchantability, satisfactory quality and fitness for a particular purpose.

We are not liable for indirect, consequential or special loss, including loss of profit, revenue, data, goodwill or anticipated savings. Our total liability to you in connection with the service is limited to the fees you paid us in the twelve months before the claim arose.

Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited under law. Your statutory rights as a consumer are unaffected.

10. Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from content you store in the service, your unlawful use of it, or your breach of these terms.

11. Changes to these terms

We may update these terms as the service develops. The current version is always available on this page with the date it was last updated. If a change materially affects you, we will give reasonable notice before it takes effect.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that consumers may bring proceedings in the courts of their country of residence where the law requires it. You may not assign these terms without our consent; we may assign them as part of a merger, acquisition or transfer of the business.
